Terms of Service

1. Acceptance of Terms

By accessing or using FlukeBase (the "Service"), operated by FlukeBase ("we", "us", "our"), you agree to be bound by these Terms of Service. If you do not agree, do not use the Service.

2. Description of Service

FlukeBase is an AI agent platform that provides:

  • MCP (Model Context Protocol) server with tools for AI coding agents
  • Persistent memory, session tracking, and task management for AI agents
  • Project management, CI/CD pipelines, git hosting, and deployment infrastructure
  • Email, content management, and marketing automation
  • Multi-agent orchestration and team coordination
  • Self-hosted and managed hosting options

3. Account Registration

To access the Service, you must create an account. You agree to:

  • Provide accurate and complete registration information
  • Maintain the security of your account credentials
  • Promptly notify us of any unauthorized access to your account
  • Accept responsibility for all activity under your account

4. Subscription Plans and Billing

FlukeBase offers Free, Pro, and Scale subscription plans. Paid plans are billed monthly or annually through Stripe. By subscribing to a paid plan, you agree to:

  • Pay the applicable fees at the then-current rates
  • Authorize recurring charges to your payment method
  • Fees are non-refundable except as required by law or at our discretion

We may change pricing with 30 days' advance notice. Continued use after a price change constitutes acceptance of the new pricing.

5. Acceptable Use

You agree not to use the Service to:

  • Violate any applicable law or regulation
  • Infringe the intellectual property rights of others
  • Distribute malware, exploit vulnerabilities, or perform unauthorized security testing
  • Interfere with or disrupt the Service or its infrastructure
  • Exceed rate limits or abuse API endpoints
  • Store or transmit content that is unlawful, defamatory, or harmful
  • Attempt to gain unauthorized access to other accounts or systems
  • Use AI agents to generate spam, phishing, or misleading content at scale

6. Your Data and Content

You retain ownership of all data, code, memories, and content you store on FlukeBase ("Your Content"). By using the Service, you grant us a limited license to host, process, and display Your Content solely to provide the Service.

We do not access, use, or share Your Content for training AI models or any purpose beyond operating the Service.

7. AI Agent Activity

FlukeBase enables autonomous AI agent workflows. You are responsible for:

  • All actions performed by AI agents operating under your account
  • Reviewing and approving agent outputs before deployment to production systems
  • Configuring appropriate safety guardrails and approval workflows
  • Ensuring agent activities comply with applicable laws and these Terms

8. Self-Hosted Deployments

If you self-host FlukeBase, you are solely responsible for:

  • Server security, backups, and infrastructure maintenance
  • Compliance with applicable data protection regulations
  • Keeping the software up to date with security patches

Our support and SLA obligations apply only to the managed hosting service.

9. Service Availability

We strive for high availability but do not guarantee uninterrupted service. We are not liable for any downtime, data loss, or service interruptions. Planned maintenance will be communicated in advance when possible.

10. Intellectual Property

FlukeBase, including its source code, design, documentation, and MCP tools, is our intellectual property. Your subscription grants you a limited, non-exclusive, non-transferable license to use the Service according to your plan.

11. Termination

Either party may terminate at any time. You may cancel your subscription through the dashboard. We may suspend or terminate accounts that violate these Terms, with notice when practical. Upon termination:

  • Access to the Service will cease
  • You may export Your Content for 30 days after termination
  • After 30 days, Your Content may be permanently deleted

12. Limitation of Liability

To the maximum extent permitted by law, FlukeBase shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or business opportunities, arising from your use of the Service.

Our total liability shall not exceed the amount you paid for the Service in the 12 months preceding the claim.

13. Disclaimer of Warranties

The Service is provided "as is" and "as available" without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, and non-infringement.

14. Indemnification

You agree to indemnify and hold FlukeBase harmless from any claims, damages, or expenses arising from your use of the Service, your violation of these Terms, or your AI agents' actions.

15. Changes to Terms

We may update these Terms at any time. Material changes will be communicated via email or in-app notification at least 30 days before they take effect. Continued use after changes constitutes acceptance.

16. Governing Law

These Terms are governed by the laws of the State of California, United States. Any disputes will be resolved in the courts of San Francisco County, California.
